Algorithm of Actions for the Cargo Consignee Upon Arrival of Cargo at the Port or Destination

  1. Inspection of the Container Before Opening to identify any violations (the “Violation”) of the container’s integrity and/or cargo sealing rules by the Consignee, including the absence of seals, their damage, or discrepancies with the transport documents (bill of lading, invoice, CMR, TIR Carnet, others). This involves the following mandatory actions by the Consignee:
    1. Visually inspect the physical integrity of the container; and
    2. Check the presence and integrity of the seals, and verify their quantity and numbers against the transport documents.
  2. If a Violation is detected during the previous step (1), the Consignee must immediately:
    1. Take photos and videos of the seal discrepancies and the general condition of the container, including the surrounding area (to document storage conditions and possible access points);
    2. Prepare a Violation report with the participation of the carrier/forwarder, customs (if necessary), and independent witnesses (if other parties refuse to sign). The report should include: the date, time, and location of the inspection; participants/witnesses and their contact details; a description of the Violation; explanations from the carrier or terminal representative (if provided); and the numbers of missing, damaged, or mismatched seals;
    3. Notify the relevant parties, including the shipper’s representative and the surveyor company, which must be called to provide independent confirmation of the Violation as per the contract terms, and provide the shipper with photos, videos, and other supporting documents;
    4. Follow the shipper’s instructions regarding unloading or further storage of the cargo;
    5. Take measures to preserve evidence, such as not discarding removed or damaged seals – store them in a labeled package with the date, location, and signatures of the participants/witnesses; and Refrain from opening the container or moving the cargo until receiving instructions from the shipper or insurer.
  3. Important Notes:
    1. Do not accept the cargo without officially documenting Violations; and
    2. Document all actions for potential claims or legal proceedings.
